lot-0001, title: acquisition of ms higher education software licenses (msfl26), description: 1. within the framework of this public procurement procedure, dkü zrt. intends to procure 1 (one) supply package for microsoft or equivalent microsoft higher education licenses to renew and expand existing microsoft license products at higher education institutions represented by the hungarnet association, to be implemented within the full 3-year duration of the clean software program, in accordance with the announcement, the other public procurement documents supplementing it (hereinafter: ekd), and the technical description that is part of it (hereinafter collectively: public procurement documents). 2. the detailed product list of the 1 (one) supply package subject to the procedure is formed by 103 price list rows according to the detailed price table / technical description that is part of the ekd (msfl26_detailed price table_mod_0601.xlsx). 3. the contracting authority states that in accordance with the interpretative provision of section 3, point 18 of the kbt., the total quantity provided for in the framework agreement is represented by the net amount of 5,200,000,000 huf (hereinafter: framework amount). 4. the contracting authority conducts its centralized public procurement procedure aimed at concluding this framework agreement in order to fulfill the tasks set out in section 14/b of government decree 301/2018. (xii. 27.) and concludes the framework agreement with the successful bidder. 5. the contracting authority records, based on the provisions of section 21 (4) of government decree 321/2015. (x. 30.), regarding the method of proving suitability and exclusion grounds in public procurement procedures, that the expected magnitude (value) of the separate contracts (orders) to be realized based on the framework agreement to be concluded as a result of this procedure is net 163,075,497 huf. this value was determined by the contracting authority based on the fulfillment data of the previous individual framework agreement with the identifier ekm01msfl23, taking into account the expected quantity volume deviation of the framework agreement to be concluded. 6. after the conclusion of the framework agreement, the specific quantity of individual procurements based on the framework agreement and the specific subject, compiled from the elements that are part of the framework agreement, will be determined during the procurement based on the framework agreement {direct order [point a) of section 105 (1) of the kbt.]} 7. the contracting authority records, based on the provisions of section 104 (4) of the kbt., that based on the direct order implemented by the hungarnet association, only the hungarnet association and the higher education institution, as the contracting authority, are entitled to contract with the bidder participating in the framework agreement, on behalf of which the given direct order is implemented by the hungarnet association. 8. the contracting authority draws the attention of bidders, based on the provisions of section 46 (3) of government decree 321/2015. (x. 30.), that in the case of reference to a specific product or type, the expression "or equivalent" should be understood. the conditions for equivalence are: - a product is equivalent if the bidder proves that the software license/solution can be fully integrated into the software and hardware environment containing the microsoft higher education software product or microsoft software solution used by the affected organizations as defined above, without the need for additional tools, developments, or services (procurement) and is operational. - the conditions of the product presented as equivalent are not less favorable for the affected organization than the conditions of the specified microsoft product. - a product is not equivalent if its operation can only be realized by unauthorized modification, circumvention, or other illegal or security-violating means of the software used by the affected organization. - considering that the technical content of this public procurement procedure is based on the enrollment for education solutions (ees) licensing technology specialized for the education sector, other licensing solutions offered by microsoft, as a manufacturer (e.g., csp), are not considered equivalent either! 9. it is mandatory to submit a bid for all rows of the detailed price table. the total net bid price must be indicated on the bid form in hungarian forints, in net value, in positive whole arabic numbers. no row in the detailed price table may remain unfilled or filled with "0 huf" (zero forints)! 10. the contracting authority prepares the public procurement documents supplementing the announcement, complying with section 57 (1) of the kbt. for clarity, the contracting authority states that by the conceptual scope of the public procurement documents, it means the bid announcement and the other public procurement documents taken together. the detailed description of the products to be delivered is included in the technical description that is part of the public procurement documents.
