Tenders are invited for Km-orthopedic implants-hip, knee, spacer, etc. Based on the framework agreement for the procurement of orthopedic implants with the placement of a consignment warehouse for the contracting authority. Abbreviations: Contracting Authority (AK); Bidder (AT); Subcontractor (AV); Public Procurement Documents (KD); Call for proposals initiating the procedure (call), framework agreement (KM). The estimated total framework amount of KM is net HUF 21,351,696: framework amount for the basic quantity: net HUF 19,410,633; + framework amount for the 10% option: net HUF 1,941,063. The procurement (direct order) will be implemented according to Section 105 (2) a) of the Public Procurement Act (Kbt.) based on the KM. The contracting authority intends to conclude a KM with several bidders, ensuring that all conditions for direct orders by the contracting authority are included in the KM. According to Section 105 (2) a) of the Kbt., the contracting authority will send direct orders to the bidders based on their total scores in the order established. The frequency of direct orders: the contracting authority plans to place direct orders weekly. The minimum size of indirect orders: the smallest direct order that can be placed by the contracting authority: the quantity specified in the call. The largest direct order that can be placed by the contracting authority: five times the quantity specified in the call. The contracting authority fulfills its obligation under Section 50 (2) d) of the Kbt. by providing the framework amount and the estimated value. The procurement will be implemented according to Section 105 (2) a) of the Kbt. If a valid bid is submitted in the first part of the framework agreement procedure and the KM is concluded with a bidder according to Section 105 (1) of the Kbt., the implementation of the specific public procurements will be carried out according to Section 105 (1) a) of the Kbt. If there are multiple identical bids at the upper limit of the number of bidders with the best offers, the contracting authority will act in accordance with Section 77 (5) of the Kbt., as the contracting authority intends to conclude the KM with a number of bidders up to the upper limit of the framework number. Evaluation criteria: The contracting authority evaluates the bids according to Section 76 (2) a) of the Kbt. - lowest price - and selects the economically most advantageous bid. In consideration of Section 76 (5) of the Kbt., the contracting authority informs the bidders that the goods that meet the contracting authoritys requirements as the subject of procurement must comply with the specifically defined quality and technical requirements, and the selection of the economically most advantageous bid is only served by the evaluation of the lowest price, considering that the goods are standard products defined and circumscribed by laws, and cannot be differentiated based on quality criteria. In order to clearly and understandably define the subject of the public procurement, the contracting authority may refer to the brand, origin, type of goods, procedure, activity, person, or patent or trademark specified in the call for proposals and the public procurement documents, based on Section 46 (3) of Government Decree 321/2015 (X. 30.). In all such cases, the naming was done solely for the purpose of clearly defining the nature of the subject, and bids can only be submitted for the products specified in this call for proposals or for products that are equivalent in terms of the detailed technical parameters concerning the given product. In evaluating the technical content, equivalence must be assessed by the contracting authority, and all data must be provided by the bidder to make this determination. Therefore, it is the bidders duty to prove in the bid that the offered product is equivalent to the product defined by the contracting authority. Any potential rejection will be factually justified by the contracting authority. Bids can also be made for products with more favorable characteristics than those prescribed.
