Tender description : Tenders are invited for agglomeration of Vodice Tribunj Srima phase II expansion of the sewage and water supply network The subject of the procurement is phase ii of the extension and reconstruction of the public drainage system and the reconstruction of the water supply network in the area of ??the Vodice-Tribunj-Srima agglomeration, specifically in the area of ??the city of Vodice and the settlements of Tribunj and Srima, all in the Šibenik-Knin County, Republic of Croatia. The works consist of the preparation of detailed designs, as-built drawings, as-built designs and accompanying documentation required for the execution of the works and the obtaining of occupancy permits and construction. The scope of the works is defined by the technical specification and the cost estimate. The works will be carried out in accordance with the terms of the construction contract for construction and engineering works according to the clients projects, issued by the International Federation of Consulting Engineers (FIDIC), first edition 1999 in Croatian translation issued by the Croatian Association of Consultants, the Croatian Chamber of Civil Engineers and the Association of Consulting Firms in Construction (the so-called FIDIC Red Book), which are amended by the special conditions of the contract given in the contract proposal. "Conditions of Construction Contracts for Civil and Engineering Works to Clients Projects", issued by the International Federation of Consulting Engineers (FIDIC), first edition 1999. represent one of the most widely codified general conditions for construction contracts, which are applied worldwide. They represent a high-quality model for regulating the contractual relationship between the client and the contractor and, in cases of public procurement in which interest from bidders from other countries can be expected, ensure a higher degree of market competition and the achievement of the purpose of the public procurement ("best value for money"). Namely, precisely because of their general application worldwide, they represent a contractual model that is equally familiar to contractors from European Union countries as well as from other countries. Knowledge of local legislation governing construction contracts would give an unjustified advantage to contractors based in the country of the client. The above are the fundamental reasons why the client decided to contract the construction part of the procurement with the application of the above conditions. In addition, the "Conditions of Construction Contracts for Civil and Engineering Works to Client Projects", issued by the International Federation of Consulting Engineers (FIDIC), first edition 1999, systematically regulate the relations between participants in construction, primarily the client, engineer and contractor, the division of risks, the manner of exercising rights from the contractual relationship, clearly define the deadlines within which certain actions must be taken, foresee the methods of resolving disputed situations, regulate the manner of extending the deadlines for execution, additional payments and generally protect both the client and the contractor in fulfilling their mutual obligations and exercising their rights. The application of the aforementioned conditions additionally ensures that the contract will be fulfilled within the scope and deadlines that have been determined and provides the engineer, as the supervisory body, with efficient mechanisms that can be used to achieve the stated goals.
