Bidders should have completed, within five 5 years from the date of submission and receipt of bids, a Contract Similar to the Project. The description of an eligible bidder is contained in the Bidding Documents, particularly, in Section II, Instruction to Bidders. 3. Bidding will be conducted through open competitive bidding procedures using a non-discretionary “pass/fail” criterion as specified in the implementing Rules and Regulations IRR of Republic Act RA 12009. Otherwise known as the “New Government Procurement Reform Act”. In addition, bidding is restricted to Filipino citizen/sole proprietorships, partnerships, or organizations with at least sixty percent 60% interest or outstanding capital stock belonging to citizens of the Philippines, and to citizens or organizations of a country the laws and regulations of which grant similar rights to privileges to Filipino citizens, pursuant to RA 5183 and subject to Commonwealth Act 138. Only the proposal of the bidders who have met the minimum technical score will be opened. In accordance with the IRR of R.A. 12009, the contract/project shall only be awarded to any criterion e.g., the Lowest Calculated and Responsive Bidder, Most Economically Advantageous Responsive Bid MEARB OR MARB etc determined to offer the optimal value for money for the City Government of San Pedro, Laguna during post-qualification. 4.
