Requirement : RENEWABLE ENERGY SOURCES IN THE ENERGY CLUSTER OF MYSZKÓW COUNTY ON PUBLIC FACILITIES IN THE MUNICIPALITY OF MYSZKÓW
Tender description : Tenders are invited for RENEWABLE ENERGY SOURCES IN THE ENERGY CLUSTER OF MYSZKÓW COUNTY ON PUBLIC FACILITIES IN THE MUNICIPALITY OF MYSZKÓW 1. the subject of the order is the purchase and installation of photovoltaic installations and electricity storage facilities on public facilities in the myszków commune (including design, delivery, assembly and commissioning), in the following quantities: - number of photovoltaic installations: 8 pieces, - number of electricity storage facilities: 18 pieces, - number of buildings covered by the project: 7 buildings. 2. the subject of the order is described in detail in annex no. 1 to the swz - functional and utility program, which is a description of the subject of the order for this procedure. 3. order type: delivery. 4. the ordering party does not specify requirements in terms of accessibility for disabled people, because the nature of this contract does not determine the occurrence of requirements in terms of accessibility for disabled people. 5. in each case when the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in art. 101 section 1 point 2 and section 3 of the public procurement law, the ordering party allows solutions equivalent to those described, and such a reference is accompanied by the words "or equivalent". 6. if it is required to submit certificates issued by a specific conformity assessment body referred to in art. 105 section 2 of the public procurement law, the ordering party also accepts certificates issued by other equivalent conformity assessment bodies. 7. by the conformity assessment body referred to in art. 105 section 2 of the public procurement law, means a unit performing activities in the field of conformity assessment, including calibration, testing, certification and control, accredited in accordance with regulation (ec) no. 765/2008 of the european parliament and of the council of july 9, 2008 establishing requirements for accreditation and market surveillance relating to the conditions for placing products on the market and repealing regulation (eec) no. 339/93 (journal of laws eu l 218, 13/08/2008, p. 30). 8. the ordering party does not reserve the obligation for the contractor to personally perform key tasks, in the manner specified in art. 121 of the public procurement law regarding works related to the arrangement of devices and their installation as part of the contract in question. 9. the contractor may entrust the execution of part of the order to a subcontractor. the ordering party requests that the contractor indicate in the offer the parts (scopes) of the order the performance of which he intends to entrust to subcontractors, and that the contractor provide the names of any subcontractors, if they are already known. for this purpose, the contractor should provide appropriate information in the offer form, constituting annex no. 3 to the swz. if the contractor does not intend to perform the order with the participation of subcontractors, he should enter "not applicable" or other similar wording in the appropriate place in the table of the offer form. 10. entrusting the performance of part of the order to subcontractors does not release the contractor from responsibility for the proper performance of the order. 11. reasons for not dividing the awarded contract into parts. the contract is awarded in two parts which are the subject of separate proceedings. the initiation and conduct of two separate proceedings constituting the entire order is due to the specificity and material scope of supplies under the renewable energy project. further division of the awarded contract into parts would cause difficulties in the implementation of the contract in terms of coordination and obtaining the designed parameters, increase the investment costs, in particular if the task was divided into delivery and then their installation, there would be a problem of "dilution" of the liability of these contractors under the warranty. one contractor would be responsible for the warranty for the delivered devices (photovoltaic modules, inverters, energy storage units) and the other for their installation. in the event of defects, the contractor who would perform the delivery could claim that the defects are the result of faulty installation, while the contractor who installed the defects could claim that the defects were the result of the delivered equipment. this would create a high risk that the costs of lack of coordination between delivery and installation would be borne by the ordering party. there is also no rational justification for dividing the contract into parts based on the division of the scope of the contract. such a division would increase the prices of devices and the costs of their installation, which means that it is not justified from an economic point of view (with a larger scope of the order, there is an effect of scale that reduces the offer price). 12. the order will be implemented under the national recovery and resilience plan, investment b2.2.2, renewable energy installations implemented by energy communities, part b: investment support for energy communities, measure b.1: demonstration investment projects implemented by energy communities.
